Not tuned with capo

Something really strange happened today. When I put a capo on 1st fret and play on 12th fret, everything is out of tune, however, without a capo it is perfectly in tune. Am I missing something or...

Combining two different set of stings?

I bought two pack of strings:
EB - Super Slinky (9,11,16,24,32,42)
EB - Regular Slinky (10,13,17,26,36,46)

My question is can I use 10,13,17 from Regular and 24,32,42 from Slinky?

Thanks for the answers. Just a little clarification. I use two finger for 3 notes. Index on E and Ringer on A+D. So it is not about whether to play two or three notes :)

I was just wondering, is it a huge problem to play power chords (7-5-5) with only index and ring finger? All of my friends use 3 fingers but when I try that I find difficult to do slides properly....
