This is why you shouldn't put guitar/bass/drums into a pop song and pretend that you're a rock star. in rock, it's easier to cover stuff up because you can be eclectic and you can cover it up with effects, riffs, solos, etc. with this pop crap that she sings, there's only so much you can do and it's already been done already anyway. now why this should be a story on ultimate-GUITAR, is beyond me.

It's a bass line i doubt she wrote it herself plus i doubt that anything any of us write is 100% original is guaranteed to sound similar to something. Theres are only so many notes and so many scales and so many chords and there's a limit on how many different sequences we can put these in.

This is rediculous, when an artist that has $$$$ comes and make that claim and proves she ripped it off then we got a problem. But these other people are "no bodies", never mad eit big and now want a peice of her bankroll...she sells millons for a reason, not technical ability but an ability to strike a chord with the general population, like it or not thats what makes a successful artists. She may not fit into your cup of tea (or genre), doesn;t fir into mine, but true artists respect everyone else's art for what it is. If she already has millions why would she jeopardize herself by ripping these "no-bodies" off, she knows it'll come back to bite her in the ass.

I can think of hundreds of songs that sound the same or have same riffs etc:

MaryJanes Last Dance (tom Petty) & Dani California (RHCP)

Come Down (Bush) & You give Love a bad name (Bon Jovi)

No law suits here bacause there is no "starving artist" factor....all you people bashing her shuold take a step back and look at your own music...i would bet a million dollars that everyone has something that sounds like something someone else has done in the past...most of the time you wouldn;t know it because you never headr that "other tune" that sounds like yours....only 12 notes you can play (a-g and thier flats or sharps)...billions of songs out there since history began...you do the math and probability stats

I think its because people like that song and if this new song sounds similar to their old song (which I think it does) they think it'll help sell as many records as Fat Lip did for AKNF.

She gave a list of her Top 5 favorite songs in an issue of InTouch Magazine, and her Top 10 favorite songs are on Rhapsody.com, both lists have "Peaches - I'm The Kinda" as her #1 favorite.

I could recognize my favorite song backwards. There's no way she went all the way through writing & recording and didn't realize that it's not just some other song she's heard before, or some song she kind of likes, but her #1 favorite song. Unless she's got Peaches in the liner notes she stole it plain and simple.

exactly...bush and bon jovi are huge therefore they dont give a shit about lawsuits on each other. but whoever the hell peaches is makes it obvious that they are a starving artist trying to get publicity, and possibly money, through avril lavigne (?). plus, speaking of sum 41, the singer helped write most of the music on that album. not a fan of avril but i must admit she is getting screwed.

If what you say is true, then yeah, I would recognize if I was accidentally mimicking my favorite song. Who wouldn't. I agree with you 100%.

All those expressing how frustrating for Avril it would be, to have people accuse you of ripping someone off. Why don't you think how frustrating it would be for those artists who never got the millions and recognition for their work and then some talentless bimbo, with a pretty face, comes in and takes all the glory knowing that she could sell the sound of her taking a shit.

Admit it, everytime you came up with something original (more or less) it was because you played something else wrong or because you experimented with things you didnt know what they would sound like. When you're composing something in your mind, you're only mixing things you've heard before, even if you cant even recall where you heard it from.
Since Avril made this album the way she thought it should be (at least so i read somewhere), meaning she comes with the idea and then plays it, it is no surprise that there are going to be lots of things similar to something else. And i dont think she was aware of that when make the record so give her a break.

i've thought that to myself...but then that's what makes a true artist! that's why we regard them as so creative because they have the talent, skill, creativty, etc. to come up with something completely new. she is not an artist, just another pop princess jumping on the mainstream bandwagon. Okay, I can understand how the claims on 'Girlfriend' by the Rubinoos might be unsubstantiated, although you can't mistake that Hey, hey, you, you I want to be your girlfriend is really close to Hey hey you you I want to be your boyfriend. However, in round two, there is no way that Lavigne had a case of cryptomnesia (thinking you wrote something original but it turns out it was something you've heard a long time ago). The base line is too similar, the lyric line follows the same pattern in Peaches song. Avril should just up and quit before William Shatner outs her about a song she might've ripped off of him (that no one would even know about because whoever has heard a full Shatner song has committed suicide).

Avril/Writing

Originally I wasn't going to post anything regarding this since I think it's absolutely ****ing ridiculous(that and I'm kinda nobody so it doesn't really matter), but for whatever reason the issue seems to be only escalating and I want to just clear some shit up. Avril is one of my dearest friends in the entire world and I find it pretty unbelievable how contorted the stories I'm hearing are. Chantal ate her words already, so I'll let that issue pass. The Roobinoos(who?) are ****ing *******s. Check out their shitty ass myspace and I think it's pretty obvious that they're dying for attention and publicity. This is a pathetic attempt to hurt someone for their own benefit. I'm not a musicologist or whatever those fancy dudes are called, but I know this: I've written a shitload of songs with Avril, (7 of which we've been lucky enough to have recorded together and release on her records) and I can honestly say that she was a huge part of creative force behind all of them. Any accusations that she isn't a songwriter are ludicrous. The one thing in common with every hit she's ever had is that she wrote on them, not someone else. The matrix, chantal, and even myself, we come and go but she'll always be writing good tunes for her records. Anytime her and I have ever written anything that resembles something else she'll make note of it and we'll abandon it, so anyone who says that she knowingly rips people off are just hating on her. It's very easy to pull and pick someone apart once they're huge, but the truth is you don't sell 25 million records unless at the core, there is a large amount of talent and innovation to drive the thing. (there is always an exception to the rule eg; Creed)

so basically, if you're a hater **** off, I think the fans of her music know the truth, and to be honest, it doesn't matter, in 6 months the roobinos will be back to serving up fries for us and Avril will be on a huge tour enjoying her long earned successes.

Avril plays the drums a “little bit” and she knows the beat it is different, she said that the “Peaches” song “I’m the Kinda” is one of her favorite songs, Avril loves the Peach, she is not stealing she is simply paying tribute to one of her favorite songs. What is wrong with that?

The Rubinoos case is so weak it will never stand up in court, It’s just sad some of you believe she actually steals songs. I’ll bet she wins any case brought up against her. But for all of you Avril h8ters, at least you know she is suffering at the moment.

If you are going to bash Avril you could at least get your facts correct, Metallica actually asked Avril to play their “Fuel” song. If you actually watched the entire video you would have heard them voice their praises of Avril and her band mates. Immediately afterward the song finished they camera cut to Lars Ulrich (Drums), and asked him what he thought, he enthusiastically said: “fabulous, great, I, it was just so cool to sit here and, it was just a mindf**k to just sit hear and check all this out. Quickly the camera cut to James Hetfield: (Lead vocals, Guitar)’ and they asked him what he thought, he also enthusiastically said: “It was pretty interesting to hear female a female sing their lyrics; Not Bad” (Laughs and smiles big time). Afterward they further interviewed Metallica, they said that they were very impressed by Avril and her band mates. The audience was very clearly in to the performance.

Like Avril or hate her she does have at least a little has talent, it is just to bad it is being wasted on sugary pop in her most recent efforts. I think that if she actually survives this and does not self-destruct, perhaps she may one day gain some street-cred, or at least a small amount of respect as a musician, she has the pipes for it. But she has to prove it and earn her respect. I clearly see potential there and I for one can’t honorable count her out yet. But time will tell.

We've been practicing every day in sound check. We don't want to look bad in front of them." During Avril’s performance the camera cut away numerous times to Metallica’s band members reactions to her performance; and they were visible impressed with her really performance. If you actually watched the entire video you would have heard them voice their praises of Avril and her band mates. Immediately afterward the song finished they camera cut to Lars Ulrich (Drums), and asked him what he thought, he enthusiastically said: “fabulous, great, I, it was just so cool to sit here and, it was just a mindf**k to just sit hear and check all this out. Quickly the camera cut to James Hetfield: (Lead vocals, Guitar)’ and they asked him what he thought, he also enthusiastically said: “It was pretty interesting to hear female a female sing their lyrics; Not Bad” (Laughs and smiles big time). Afterward they further interviewed Metallica, they said that they were very impressed by Avril and her band mates. The audience was very clearly in to the performance.

Like Avril or hate her she does have at least a little has talent, it is just to bad it is being wasted on sugary pop in her most recent efforts. I think that if she actually survives this and does not self-destruct, perhaps she may one day gain some street-cred, or at least a small amount of respect as a musician, she has the pipes for it. But she has to prove it and earn her respect. I clearly see potential there and I for one can’t honorable count her out yet. But time will tell.

When I bought my first Metallica album(yes, ALBUM), the record store had never heard of them and had to order it. I was a HUGE fan for many many years and have all their albums, and have seen the incredible stage show more time than I can count. I consider them on a level almost comparable to Led Zep. Not quite, but close. No one who knows anything can deny that they were the absolute pioneers that brought back real metal in a time when it was just being mass produced and anyone with enough hair spray got signed. Anyway, I'm not looking for a stupid ass internet arguement. I just cannot stand this chick. Just my opinion, but I would walk on my elbow 100 miles to take her cd out of the player.

Hey I am no youngster either and I love Metallica too, although I give the nod to Led Zeppelin (I saw them in 77 in Seattle), my first album was john "John Barleycorn Must Die" by Traffic. Hey I am not trying to expand this in to a full-blown Internet argument either. But I will do my part to defend my fellow musician or anyone else that I think is being falsely accused. I just think there is a frenzy to destroy Avril right now and I know in the end it will be proved out in the end she is innocent. Innocent before proven guilty is something we must never forget, because otherwise it will be the end of life as we now it. -Zebo

I dunno, I'm guessing she's innocent too, however there's no way that Avril Lavigne of all people could make a metallica song better. Once again, Avril is a talentless unoriginal pop singer, who I used to be able to stand but now it hurts my ears just to listen to her, and I really do hate that crappy "girlfriend" song.

Rubinoos versus Avril

As many of you may be aware, a band called The Rubinoos are suing Avril Lavigne, RCA Records, Apple and myself. They claim that we stole from their song "I Wanna Be Your Boyfriend".

I have held back from addressing this matter publicly, but it is time for me to share my views.

Before this issue arose, I had never heard of this band and I had never heard of their song.

An independent and highly respected musicologist found no copyright infringement:

"When the various lyric and music elements of both Boyfriend and Girlfriend are examined it is readily apparent that although these compositions contain some similarity in one section of each work, they are overall distinctively different compositions. Furthermore, the lyric elements that are the same or similar are not protectable or original with "Boyfriend". Therefore any legal claim of infringement by "I Wanna Be You're Boyfriend" against "Girlfriend" would be unjustified."

I am also confused by the point of the contrived video clips of the chorus from "Girlfriend" followed by the chorus from the Rubinoos "I Wanna Be Your Boyfriend" that have been posted on the internet. These have been radically digitally altered and transposed to make the songs sound more similar than they are. Playing the Rubinoos' song along with Avril's video, attempts to further confuse the public and connect two separate things. It is odd that if the songs are so close, they must be manipulated so much. When the songs are listened to in their entirety, it is evident that they are two very different songs with very different meanings.

I have come across thousands of songs that are similar. When I was 13 and learned to play "Wild Thing" on guitar, I soon realized I was playing the same power chords as "Louie Louie". Another example that you may be familiar with is: "Do You Love Me" by The Contours and "Twist and Shout" by The Isley Brothers.

All musical styles rely on melody, rhythm, harmony, and lyrics that are reused in an infinite variety of combinations. There are bound to be innocent similarities between compositions, especially within a given genre. An obvious example is the blues. There are thousands of songs with the same form, the same chords and many of the same lyric ideas. These elements define the genre.

Most importantly, I would like to address the hurtful and untrue statements being made about Avril's songwriting. It is not possible for anyone to state what an artist contributes to the creative process unless they witness it themselves. I have written with Avril and know that she is a talented songwriter with great ideas. Don't take my word for it. Ask Butch Walker, Evan Taubenfeld or The Matrix. Her success remains undeniable.

paramore_fans, in the other topic (the one about the other "stolen" song) you told me you were trying to find a female guitarist that was better than Avril. I don't know of many female guitarists, but you could try the rhythmic guitarist/keyboards for Skillet (Christian rock band), or the lead guitarist for all female Thrash Metal band Meanstreak, who is wife of the ever talented John Petrucci, and although she isn't the best guitarist she's many times better than Avril.

And playing powerchords/strumming are both the most basic skills for guitars, so no, I'm not impressed by her guitar work. And from what I've heard, even her rhythmic skills aren't that good. Even Brad Delson (Linkin Park) beats her supposed guitar skills, and although I like linkin park, Brad Delson has very little talent.

And one note about your last post: You have 3 questions there when only the last one is relevant. No one here cares what songs Avril does in her live shows, no one here cares who's going to be in the video for her next single, so only the last question really needs to be there.
