Metallica Sue Video Game Companies: Updated

Harmonix confirmed back in July that the legendary rock band Metallica is coming to Rock Band (PS3 and Xbox 360). Also earlier this month both Red Octane and Activision came up with a similar announcement for Guitar Hero III that is scheduled to be released on Nintendo Wii, PlayStation 3, and Xbox 360 platforms.

But what's this? Qj.net just got word that Metallica is currently suing the above mentioned companies for copyright infringement. According to the band's lawyer, what the three companies is planning to do is actually under the "licensed music to player" system otherwise known as LM2P network.

Harmonix wasn't able to provide an initial statement regarding the matter but the counsel for Red Octane and Activision had this to say:

Our company paid a licensing fee to feature the track 'a' by Metallica in Guitar Hero III. We don't understand why Metallica would turn around and sue us, unless they've gone from insane to completely bats*** insane since 2001, but we're confident that the law and our contracts will be enough to have this thrown out.

Metallica's counsel, on the other hand, explained that the band is fearful that album sales will decline because consumers can easily get hold of their songs just by purchasing video game titles. The lawyer added, "The band learned its lesson the hard way with file sharing in the late 90s. This time they want to do a pre-emptive strike before the music gets out there".

Update:

Over on the Harmonix's forum boards, HMXSean, one of the community forum leaders, chimed in with an important announcement, stating that the article originally written by Daily Gaming is false.

According to the forum post, HMXSean said, "In no way is this true. It is well written satire but it is very much satire."

No professional business person embroiled in legal trouble is going to use the wording they did and this is not the first time UG has falsely reported a Metallica lawsuit (Such as the "Metallica sues Canadian band over chord progression" or "Metallica sues Beatallica" debacles, the first of which was false and the second Sony was suing Beatallica and Lars ponied up for Beatallica's legal defense).

I could understand a struggling underground band doing something like this but not ****ing Metallica. They need to get their head out of their arses and think "Jesus, we actually don't need more money and enemies."

Okay, first off yeah Lars is a piss-ant we all know that and i guarantee that this has stemmed out from the whole napster lawsuit. Someone who is pissed off because they got sued along with napster and had to pay out the ass for it. Like what has been said by the head of the one forum its most likely false. I might not like some of their later stuff but I would never rip on the boys for doing what they wanna do. Fans should not dictate what bands play. That is just crap.and im a fan of Metallica. Why would they not have control over what new material goes on a game? and how does "just" getting a 90 dollar game decrease their sales? maybe if they made better albums and didnt charge 75 bucks to see new shit music they wouldnt have such a problem. This is rediculous and i hope people continue downloading them and ridiculing them because just like the jokes, they really are caricatures of themselves.

i find it kinda gets annoying every metallica article or anything always the same comments...Metallica used to be good in the 80s now they just suck....some from people who probably weren't even alive during the 80s to know what the scene was like.....you can hear all the songs and see all the shows about what it was like but being there is a different thing....i saw metallica back then....i also saw them a few years ago...and i saw mostly the same faces on stage as i did back then.....i don't get why ignorant people always trash them for thier recenter work, just cuz it doesn't sound like thier first few albums...i think its good stuff....and yeah its different but i for one would be bored of the same style of music and playing it for over 20 years i see no problem with them changing it up.

On a side note about metallica, I was at ozzfest chicago last weekend which was awesome, but I heard a song in between bands that sounded a lot like metallica but I never heard it before. I dont know if they were trying to sneak in a new song for some reason, but if it was, i'm looking forward to hearing it again. The song was rockin hard.

You still might not like St.Anger... but you'll appreciate what they were trying to do more. St.Anger was back to their roots whether you really like it or not. It was fast, it was moody, agressive. It had some serious punch. You can't be around as long as Metallica without reinventing yourself. Actually they have one of the best best selling back catalogs currently, maybe people should think for themselves and not just mindlessly attack Metallica just because they're the biggest metal band. i really respect what ya said there man. i agree with the load/reload thing. if any other band under any other name were to have put those out, i bet all these metallica fans would love that band and love those songs. but since metallica experimented with some new styles (aka "sold out" as people love to say) so many people will refuse to listen to same great songs on those albums.

depends. If i was stinking rich, and i didnt get an extra $10 million on top of my $30 million, but i knew that i had essentially just given $30 (price of cd in nz) to hundreds, thousands of people, id still be pretty happy. theyre still fans, and fans come to shows.
On the other hand, while its not metallica that really should be getting upset, at least someone is. Maybe, they could really solve the problem and reduce the cost of a cd. Id pay $10, maybe even $15. But $30, or more? F off. Ill admit to downloading, mostly stuff i cant find in stores or bands that i dont really know or like enough, but if cd's were cheaper, id buy em.

You still might not like St.Anger... but you'll appreciate what they were trying to do more. St.Anger was back to their roots whether you really like it or not. It was fast, it was moody, agressive. It had some serious punch. You can't be around as long as Metallica without reinventing yourself. I think this next album is going to really blow people away... and I think as well this is going to be their last record. They have alot to prove still... I can't wait.

But if you watch Some Kind Of Monster... and you pay attention to the turmoil within the band, kids, everything like that.
