Metallica Sue Video Game Companies: Updated |

Harmonix confirmed back in July that the legendary rock band Metallica is coming to Rock Band (PS3 and Xbox 360). Also earlier this month both Red Octane and Activision came up with a similar announcement for Guitar Hero III that is scheduled to be released on Nintendo Wii, PlayStation 3, and Xbox 360 platforms.
But what's this? Qj.net just got word that Metallica is currently suing the above mentioned companies for copyright infringement. According to the band's lawyer, what the three companies is planning to do is actually under the "licensed music to player" system otherwise known as LM2P network.
Harmonix wasn't able to provide an initial statement regarding the matter but the counsel for Red Octane and Activision had this to say:
Our company paid a licensing fee to feature the track 'a' by Metallica in Guitar Hero III. We don't understand why Metallica would turn around and sue us, unless they've gone from insane to completely bats*** insane since 2001, but we're confident that the law and our contracts will be enough to have this thrown out.
Metallica's counsel, on the other hand, explained that the band is fearful that album sales will decline because consumers can easily get hold of their songs just by purchasing video game titles. The lawyer added, "The band learned its lesson the hard way with file sharing in the late 90s. This time they want to do a pre-emptive strike before the music gets out there".
Update:
Over on the Harmonix's forum boards, HMXSean, one of the community forum leaders, chimed in with an important announcement, stating that the article originally written by Daily Gaming is false.
According to the forum post, HMXSean said, "In no way is this true. It is well written satire but it is very much satire."
Thanks for the info to Qj.net.

T his story is entirely falsified. Anyone reading the initial articles should be able to tell it's fake. No professional business person embroiled in legal trouble is going to use the wording they did and this is not the first time UG has falsely reported a Metallica lawsuit (Such as the "Metallica sues Canadian band over chord progression" or "Metallica sues Beatallica" debacles, the first of which was false and the second Sony was suing Beatallica and Lars ponied up for Beatallica's legal defense).

Someone who is pissed off because they got sued along with napster and had to pay out the ass for it. Like what has been said by the head of the one forum its most likely false. But because of the bands past it could be true. Let sit back and see how this folds out if nothing more is really said lets back metallica if they are suing it should be the end of the bands career.POSTED: 08/15/2007 - 11:25 am / quote |

i've never heard a song called "a" by Metallica
"Metallica's counsel, on the other hand, explained that the band is fearful that album sales will decline because consumers can easily get hold of their songs just by purchasing video game titles."
why would they be worried about people getting their songs from video games? only one of their songs would be on one video game.
and if someone plays that game and hears one of their songs they may like it and buy the album
plus, if someone was looking to get their music, buying their cd is alot cheaper than buying the whole video gamePOSTED: 08/15/2007 - 12:06 pm / quote |

I might not like some of their later stuff but I would never rip on the boys for doing what they wanna do. Fans should not dictate what bands play. When you start out playing guitar, you play what you wanna play not what others tell you to, why should that change when you get signed? Get over it. That is just crap.and im a fan of Metallica. Why would they not have control over what new material goes on a game? and how does "just" getting a 90 dollar game decrease their sales? maybe if they made better albums and didnt charge 75 bucks to see new shit music they wouldnt have such a problem. That is the stupidest thing I have ever heard. People buy video games for the game itself not the music. Why the heck would someone buy a video game just for a song or two when they can buy the bands cd for alot cheaper.
They are basically saying that someone will buy a video game for $60 cause it has a metallica song on it instead of paying $15 for their cd with that song on it. And the dumbest thing about this whole thing is that metallica agreed to have their songs in these video games. I disagreed with metallica sueing napster but I could understand where they were coming from, but this is just total bullshit.
