Okay, so I randomly heard the song I Love College by Asher Roth, it's some ****ty rap song, but it's 100% true. But I also realized that it's completely the same music as Say It Ain't So by Weezer. I'm talking almost dead on. It's just the verse repeated over and over again.

1. Sampling is an art form within itself. DJ Premier, Kanye, Dre... All musical greats up there with the best of them...

2. The song used the weezer say it aint so riff without rights at first. It was just a myspace song. then the song blew up and weezer didnt clear the sample. In the new version he has someone else playing almost the same chords.

3. I love my strat, I love my Ovation (well not really but you get the point) and I love my MPC. I make music with all of them. In fact I SAMPLE my OWN STUFF. but sampling has been used over and over by rock and hip hop musicians alike. I dont think its fair to say someone who samples is not an artist. When the Beastie Boys sampled the Levee breaks, i thought that was one of the dopest things i have ever heard. I doubt many on this board would accuse Rick Rubin of being a talentless producer and he samples ALL THE TIME.

I heard that song on the radio yesterday. I must say, it's incredibly catchy. It's definitely not what I would consider a well written song but it's definitely chill and I think it highlights the college party scene pretty well.
EDIT: And yes, it's sampled. If you watch the uncensored version in the beginning he says "what's this Weezer?"

the saddest part is that the rip off song has the exact opposite message of say it aint so.

say it aint so is against alcohol, its telling about how his father was an alcoholic and how it made him afraid of alcohol and all the bad things that it's done.

i only listened to 30 seconds of the other one, but the first like 'if you have a drink, hold it in the air' is offensive to the meaning of say it aint so.

i really think that people should have more respect than that.

Welcome to the world of western music harmony. You'll find that there's a limited combination of diatonic progressions all based off of iii - vi - ii / IV - V / vii° - I. This case is no different.

theres a difference between a similar chord progression and the exact same melodic motif.

Do you have any idea how incredibly generic and ubiquitous that rhythm is? Popular music always stay right on track in cliches and diatonicism. It's bound to have songs with identical harmonic progression and rhythms.

the rip off version would have had to ask permission to use it. thats because the rhythm and melody of a song can be copywritten. there is no question that it's a sample of the weezer song. i dont understand why you dont see that...

There are going to be hundreds of songs out there that sound like that. Anyway, you can't copyright a chord progression, and it would be stupid to attack people for using something similiar.
