I've been writing a concept record and have been recording it. In between all that, I've been thinking about album art work. I based the town in the record on Elberton, GA and there is a building in Elberton that I would like to feature in the art work. it is a church actually. I'm not using a picture. the art work is being drawn, so I could just make some changes to the building itself if needed. But do I need permission to use the building or is it open game for the fact that its a public place? I mean, it's not really a business, so they cant bitch about using their product.

lol. problem is, I live in Washington state. lol. but I'll probably call to be on the safe side. It'd just be good to know for future reference.

copyright can be applied to the edifice of a building, so I'd definitely check.

That might apply if he was building a copy of the building, but using the image for album artwork is very unlikely to cause any problems.
I'd probably ask anyone, just out of courtesy.

I've just checked, you can't violate building copyright by taking a photo/creating artwork using it. As a photographer or artist, you own copyright of the image/artwork.
