Ok some crap happened at work today.

My job is to cut down the trees for logging roads. We use chain saws.

Anyways when I was done working I headed where a few other guys were taking a break. I place my chainsaw and the rest of my shit on the side of the road where everyone else s stuff is.

To get to the point, a truck was parked right by our break area, and when the guy left ( one of the workers too) he ended up running over my saw and all my stuff twice (front and back wheel) .He also ended up running over another guys day bag and sweater.

So who's fault is it and who should pay for it? I'll put up a poll. If I have to pay for a new saw I'll freak out those tihngs are expensive. The saw belongs to the company and we have to pay a monthly rental fee to use it.

The guy who ran over it. He should've seen where everyone's stuff was. His fault.

Thats bullshit if you have to pay for it imo. Maybe you didnt put your saw in the best spot (i doubt you guys have designated saw areas) but the driver shouldve been a little more resonsible and looked where he was driving.

EDIT: idk what youre deal is with the rental saw company but they could just pull the ol "its your posession so youre responsible for whatever happens to it" if thats the case, I doubt the driver will pay for it. sue him

He said he didn't see it and it should of been further away from the shoulder. But if you hit somebody you can't use the excuse that you didn't see them, hopefully it applies tot his case and I don't get charged for a new one.

Was your stuff on the road? Or at the side of the road?? If it was on the road, then it's both parties fault. If not, then it's his fault as he didn't drive on the road.

Officially, it should be the drivers fault. He is to be aware of any obstacles and obstructions around him.

However, if you dropped all your stuff next to everyone else's, directly behind the truck, then it is technically your fault, but still probably officially his fault.

Does you rental fee not include insurance for this kind of thing?

The rental fee is because the company is too poor/cheap and the owner is really greasy ( so I"ve been told by a lot of guys). We'll see what's more important the saw or the worker, cuz I'll quit if they try to charge me for a new one.

There's no real boundary since it's a dirt road still, but it was on the part that would be considered the shoulder. I took a picture of the tire tracks and it shows that he did not pull out of the shoulder until like 10 meters past our stuff.

So, he ran over your stuff, continued for 30 feet, and then turned onto the road? I'm sorry, but if you run over a chainsaw with a truck, you're going to notice, it'll feel like a speed bump, the guy knew what he did, he prolly just kept going because he's a coward.

I say you're in the right, and the guy in the truck should pay for his stupid mistake.

It would be more difficult to decide if the guy had only ran over it once, but twice?? I'm sure he realized something was wrong after the first wheel went over the chainsaw. His fault, man.
