http://www.cosmopolitan.com/lifestyle/news/a31262/texas-appeals-court-rules-for-upskirt-photos/

It's not a real news source but that's where I read it from and I can't be arsed to search for a better source on my phone.

Thoughts?

In an 8–1 decision, the appeals court described upskirt photos and similar gross practices as "inherently expressive." In the majority opinion (via The Houston Chronicle), presiding judge Sharon Keller wrote that "the camera is essentially the photographer's pen and paintbrush."

Well it's not too surprising, the Supreme Court thinks cartoon kid porn is okay so
I think it's even more messed up that the decision was 8-1.

All of the imaginary children in those drawn CP rings and the supreme court doesn't want to save them, what the hell is wrong with this country

This is probably a crap shoot loophole to get women to stop wearing skirts and cover their legs.

Thanks Texas. Thanks for ruining it for everyone.

Skirts attract rapists and should be outlawed.

There is some truth in this article

"You can't prevent someone in public from looking at you and having dark thoughts."

Don't ask me how this relates to taking upskirt photos though.
#19
At first I was like "well of course it's free speech if it's done consensually."

Then I read into what this actually meant and wtf.

It is not. One is art one is violence.

Seriously. This is a good thing. You don't want people that make a photo of their family and accidentally have someone with a skirt and no underwear next to that family, to be violating a law. Just wear some damn underwear.

Yes, just what every woman wants to hear, "Oh, if you just wear underwear, the Texas upskirt thing won't be a big deal".

Better not have your name on those panties.

Those poor Scottish migrants living in Texas. I also feel for those going in for the pure Scot shot to get a real haggis experience.

So basically what we are saying is that people have the right to wear what they want. But if other people make pictures in a public place they are violating laws? Why not have both? Wear what you want but don't Bitch if people make a stupid photograph. In the gay parade here there were guys and women whowear the smallest latex or leather "clothes" that didn't cover much. I have no problem if people walk around like that, but they shouldn't Bitch about it if someone takes a picture. Freedom of expression goes both ways.

The general expectation is that the outside of one's clothing is public and the inside/whatever is being covered by other clothing is private.

I do not see a problem with this, assuming we're talking about photos taken in a public space.

I took a look at some of those, it's a much as pornography as you taking a picture of yourself partially or fully exposed.

I don't see how one can put a camera on the inside of ones clothing. But that would be violating a law certainly.

The case stemmed from the arrest of a man in his early 50s named Ronald Thompson who was stopped in 2011 at Sea World in San Antonio after parents reported him swimming with and taking pictures of children aged 3-11. The local district attorney’s office said that he tried to delete the photographs before his camera was seized and a police examination of it revealed 73 images of children in swimsuits “with most of the photographs targeting the children’s breast and buttocks areas”.

After another appeals court declared the statute unconstitutional last year, the Bexar County district attorney’s office issued a press release titled “Cover up while we appeal!”

So what, just cuz he was taking pictures of the water and the kids' genitals got in the way, we're gonna take away everyone's rights to take pictures of water?

Maybe those kids in that pool should've put jeans on, then others will be less inclined to take sexualized pictures of them.

Wear short shorts under the skirt, alternatively, just tell any nearby white knights a perv just took a pic up your skirt if you catch them in the act. Someone might bash their head in for ya.

Saying "mah freedom" isn't gonna stop someone's boyfriend from glass'n ya. Whether you're legally in the right or not. Or the girl herself from doing the same, or mace.
