second year who slapped a girl’s face with his flaccid penis as she lay sleeping has been jailed.
Criminology student John Luke Dale, 21, stripped to his boxers and attacked her as a friend filmed the act with a mobile phone.


But the idiotic prank backfired when the pal showed the video to workmates and the police were called.
Dale, originally from Milton Keynes, admitted sexual assault and was jailed for nine months at Nottingham Crown Court - potentially shattering his dreams of a career in law.
Yesterday lawyers tried to overturn the sentence at the Court of Appeal, but three top judges rejected their case.
The victim told the court she feels violated and was worried that the video may still be out there.
She said: “It makes me think that it could still be out there in someone’s possession and that anyone could have it.
“Knowing that it could exist petrifies me.”
Dale’s barrister, Trevor Burke QC, argued that his sentence was too tough and claimed that Dale had received no sexual gratification from the act.
“What it was was a stupid drunken incident that lasted a very brief period of time, where he slaps his flaccid penis on the head of a sleeping woman,” he said.
“It was extremely unpleasant, but not driven by any sexual motivation on his part.”
He claimed the student had done everything he could to mitigate the offence and even vowed to keep away from the university until his victim had graduated.
Dale had moved back to his family home, where he was being kept under curfew by his parents and working for his dad to earn money to pay the victim compensation.
The appeal was rejected as it was thought that the victim had undergone “obvious and significant stress”.


Stupid thing to do, but 9 months in prison!? Pistorius got 10 months for killing somebody.

If you pardon the pun, he was a complete dick for doing it anyway, but 9 months inside (OK he'll do half that maybe less) seems rather harsh (look up Stuart Hall's sentence for far, far worse).......mind you it's gone to appeal and 3 judges in the appeal court didn't think so. What about his so-called "mate" showing the incident to people? Some mate that is.

I remember seeing some chart of how well different majors did on placement exams and the like when becoming lawyers and criminology students were dead last. That's why most of them become cops and stuff I guess.

I'm not sure why a lack of gratification means it isn't sexual assault. It very clearly is sexual assault. Although I'm not surprised that you'd undermine the event as simply silly and stupid and immediately empathize with the perp.

His motives are not important. Why he did it doesn't matter. What matters is the consequence of the action on the victim, and yes this very much equates to rape.

I would agree. I'd say slapping someone with your genitals while they're asleep is worth 5 or 6 months though. Still a form of sexual assault. If he did it out of malicious intent or he was getting off on her helplessness then 10 sounds fine. Crossing the line to rape should get you significantly more than our current laws.


Yea, it was a stupid thing to do but maybe people will learn that this isn't ok. Maybe it's just me but young men are dumb as shit a lot of the time.

I'm not talking about his sentencing within a legal system, I'm talking about TS stating that it isn't rape, and the assailant's lawyers stating that he didn't do it to receive sexual gratification, which means it isn't sexual assault. I was just stating that when it comes to rape, there are plenty of non-sexual motivations that drive perpetrators, so we should instead look at the effect it causes on the victim rather than why the attacker committed the assault. I mean, we aren't in a courtroom, I'm not discussing law. As well, the law doesn't make any differentiation between what constitutes a "silly prank" and sexual harassment.


I certainly hope it doesn't undermine it. Can you explain why? I don't think there are "degrees of sexual assault", with slapping someone who's asleep with your genitals is at one end of the spectrum and holding them to a knife is on the other. The result is of both still likely traumatic (could you imagine believing that you might be known around campus/the office as the person who had this happen to them? Could you imagine their discovery of the incident? Realizing that a once safe-space is not so safe anymore?).

If you can't see the difference, I'm not sure I can adequately explain it, but I'm pretty sure fear of death while being forcibly physically violated is significantly more traumatic than the after-the-fact embarassment suffered in the incident under discussion?

Yes this woman unknowingly was taken advantage of in a vulnerable state and will permanently suffer friction burns on her face from skin-skin contact the rest of her life. Okay, maybe I used a bad example. I'm thinking the problem here is semantic: defining rape as the latter example. Cuz BladeSlinger differentiated between "rape" and "sexual assault", which I see as the same thing. Groping someone on the bus is as much rape as drugging someone, although you might define the latter as rape and the former as "sexual assault", and I didn't mean that the consequences on the victim didn't come in different degrees, but the act by the attacker itself shouldn't come in different degrees.


Again, I genuinely don't want to undermine anyone's experiences. I was actually trying to do the opposite; the lawyer's argument and TS categorizing this as simply a dumb prank is what I saw as undermining the victim's suffering in this case, which extends beyond a simple embarrassed blush as some people might imply. What the guy did is still a violation of someone else's body, he used his genitals and video taped the incident.

Explain this please. I should restate that I don't think the act itself should be classified into different degrees despite the possible consequences being in different degrees.

You do realize that 1) the worst results of rape isn't physical damage, 2) I never said that he should get more than 10 months, I actually never commented on what I think of his sentencing and my posts have been concerned with others' reactions to the incident and 3) even if you don't agree that the act was seriously harmful to the victim's well-being, you seem not to be worried that it's still a possibility and are willing to go on undermining what could possibly be an emotionally painful experience? Wouldn't you rather err on the side of caution?
