She unzips my pants. I take off her bra. We're making out and both getting so turned on. She bites my neck. I lean in close and whisper in her ear, "I have a few forms I need you to sign real quick".

How do you define consent? What is it? Have you seen the "consent is sexy" video? Did you laugh as much as I?

Is non-verbal consent ok? Is consent implied in a relationship? These are questions

Non-verbal consent is okay. Consent is not implied in a relationship.

I think non-verbal consent is fine. Taking a pause and saying "can you just confirm that we can proceed" or something like that is going to ruin the moment

And unless they are outright saying "no" or "get away from me you creep" consent is implied anyway unless it's a mute who can't say no
I have nothing important to say

Consent is pretty hard to figure out. Marvin Gaye for example never really consented to Robin Thicke.

Robin Thicke was just like "I HATE THESE BLURRED LINES!"
If there is a God, it's me.

Non verbal consent is fine.

But you gotta be very careful and read body language and stuff.

Consent is never assumed in a relationship.

It's generally context dependent

Some people need to give a hard yes in order to feel comfortable, and in other situations it's more of fluid ongoing thing.

Seems valid to me, what's wrong with this

I believe past a certain point of inebriation it doesn't matter if they say they consent it won't count.

But I'm not a lawyer.

Consent is something I probably should ask my buddies for next time I send them a drunken snap of my johnson with a party hat on top.

I think it's better to define what isn't consent. Much easier. Obviously if they say "No". Resisting could be non consent but what if it's some kind of fetish? It's a slippery topic

This is anecdotal and specific to my experiences:

Within a relationship, you have a developed standard of rapport. After you go 20toes with someone the first time, it seems that the "no touch" standard of personal space becomes less taboo. You've likely experienced the difference between physical contact an "fun touches", and you have a mouth to communicate the difference. If she's riled up, and he just wants to finish watching his sportsball game, he can say "no", or divert that fun touch to something more romantic. Non-verbal consent, or even verbalized consent from a non-verbal advance should be fairly easy to identify. I'd hope most of us are on the same page here and aren't just doing it because your partner said "lets go". At no point is it okay to take exactly what you want without responding to objections.

I suppose this largely applies within new or starter relationships too. He does a, she doesn't object. He pushes for b, she doesn't object. He's getting waved on to 3rd base, and she's a bit timid but doesn't stop him. As long as there is a clear understanding of comfort, non-verbal communication should be copacetic. This is violated when 1 party decides they want to hit a point of advancement and forces their hand.

Verbal seems a bit excessive unless you're completely unsure of how you're reading the situation. You should default to this if you're completely unsure of where things lay, but asking "can I put my little boy parts inside your nono-box?" can be a total momentum killer.

I've not been in the mood for it before and didn't decline an advance. My partner asked what was wrong. There's an obvious addition of effort to most of these situations that indicates desire. When it's not there, the other person should be able to tell.

Now - the whole idea of intoxication and 'regretsy' situations is an opinion-rich area that offers tons of grey areas and debate - but I don't know that the thread was intended to go there.

"hello fair wench, do you desire thee intercourse?"

nothing is less sexy (that isn't direct assault) than going "do you wish to have sex" when your partner is naked, smiling and touching your genitals. If that isn't enough to make what happens next clear I have no faith in our language either.

okay so unless you two are really humoring me it's not just me that thinks this stuff is weird

I see stuff on Tumblr saying that you basically have to sign a contract (this is a strawman) before you fuck and

nah I mean surely it's self-evident?

At that point - you've generated a verbal contract, to which, I think it illegal to fornicate under contract (prostitution, anyone?) for any reason other than recording and re-release (pr0n) under the subheader 'entertainment'.

They got ya coming and going. Looks like you'll have to tape the whole thing and sell it on the internet - but only if she says that's okay too.

As far as I can recall, yes. I mean, I give up really easily, so I've got no experience of borderline cases.

imo it's pretty self-evident and if you're having sex with someone, surely you can pick up on cues well enough to be able to recognize "no" and "yes" and act accordingly with your partner's wishes and ability to consent.

But I'm also in a long-term relationship, so yeah, I don't run into ambiguous sexual situations ever anymore.

It's actually pretty easy to have a fairly high(or even illegal for driving) BAC the morning after some moderate* drinking.

*That's moderate for Scotland

No, just say after she agrees to be in the porn movie.
Next day she goes man I was drunk, "hey 911, I was raped and forced to consent to be in a porno"
I was too drunk to consent.
I'm asking if being too drunk should be a legimate excuse for why consent was given.

I'm pretty sure tests exist to find out of someone had been drinking the night before
