That song uses heavy chorus on top of a whole lot of gain. He has a lot of gain to add to the smoothness.

I'd suspect he's using his Legacy (a hot rodded fender basically) with his modded DS-1 from Keeley, tubescreamer, and whatever chorus he uses.

EDIT:
OHHHH! Your talking about right before the tremolo picking part leading up to the solo.

He's basically diving the strings until they rattle on the fretboard and pickscraping.

To get the sound, I use Seymour Duncan humbuckers at the neck position, with any high gain distortion on 7 (American high gain preferably), a slight stereo chorus, and hall reverb (reverb is important in this song)
Settings are :
Treble - 7
Middle - 4
Bass - 5

You either have a lot of chorus and small reverb, or a lot of reverb and slight chorus.

It's a computer problem, if you could put it on a site that hosts it and autoplays it I could give it a listen but anything that requires downloading is undooable...that's what I get for downloading Counter Strike.

I'd probably give it a little more gain to add some sustain, it seemed as though some of the note's weren't carrying through long enough.

Other than that, the mix of effects worked well at recreating Vai's tone.

About the sustain, well i woke up like an hour ago, so im still abit tired :P couldnt hold the notes, and i reduced the gain so i dont get extra distortion and noise in the record.

I use a Samick Concorde http://www.gregbennettguitars.com/images/cd2mbk.jpg (For 300 $ i dont think you can get a better guitars)

-Korg AX1500G Pedalboard (I bought it new last month for 185 Canadian dollars)
No amp, I just connected the pedalboard straight to my mic-in in my n00bish soundcard and recorded it with Cakewalk Sonar.

Settings :

Neck pickup, Tone = 10
US High Gain
Treble 7
Middle 4
Bass 4
Gain 4 (when recording) -- Gain 6 (when playing through amplifier)

Amp simulation : 4x12 Vintage

Classic Chorus

Hall Reverb.
