i have a guitar and its a "38 inch" guitar, i dont think this refers to scale size, so would it be considered a 3/4 scale guitar?

Scale length is twice the distance from the nut to the twelfth fret (not the distance from the nut to the bridge as most bridges are compensated). Most guitars of the Strat/Tele persuasion tend to run 25.5" whereas most guitars of the Les Paul persuasion tend to run 24.75". Most guitars you find will have one of these two, however there are numerous exceptions: PRS almost always uses a 25" scale length, Some of the oddball fenders used 24" or 22" scale lengths, etc.

Most "junior" guitars have a 22" scale length.

You must have read something wrong somewhere, even basses only run to 35" scale length at the most.
