the 4th would have diminished third...

are you sure that mode exists? in the normal minor scale... i can imagine it might in the harmonic minor or melodic but then it would be called a mode

There's no such thing, a minor mode has to have a flattened third.
The phrygian mode has a flattened second, third, sixth and seventh if that's what you're looking for.
