So, at my school Friday, there was a fight. A guy I know got a video of it on his phone, and the teachers took his phone. It is of course perfectly legal for them to take his phone, and view the video, as it could be considered evidence, but they deleted it. I'm just wondering if it is legal for them to delete it.

Does it matter? I don't think you can take someone to court for deleting an inconsequential video off your phone.

It's legal for them to take it, and even view the video. First of all, we're not allowed phones in school, so they can take it. Second, the video could be used as evidence.

School rules do not equal legal authority.
(I'm pretty sure) in Canada, even the police aren't allowed to take your phone unless they have a warrant.

We are aware of the rule, so they will say that if we didn't bring the phones to school, they couldn't take them. They would also just say it's evidence and be off the hook.
And yes, I could live without it, but it will make my life better to live with it.

Anyways, if they deleted the video, why does it matter? It's not like you'll be able to watch it anyways. Just go talk to some people who saw it.

but you dont know the people on the interporn. knowing them irl makes it alot more funnier when you see them the next day. specially if your close you can say something random like "man i think you were in my dream last night aye"

Because they guy wants to know if he can take any legal action for it. I'm pissed off because things like this happen all the time, and it bothers me the way students are treated at my school.

I'd think that they'd only be liable for anything if the video WAS being used as evidence in court.

just deleting the video wouldn't be illegal (afaik). Actually, I think you might need permission to film anything on the schools property so they could have the right to delete the video because the person didn't have permission.

but only a qualified lawyer would be able to tell you the exact law in your area.
