It has to be below the nut. If you look at a Fender, it's kind of carved below the nut, but is still horizontal. However a Gibson will have the angled headstock instead.

my tele doesnt have an angled headstock, but its kinda set back from the level of the neck.

there needs to be a gap between the height of the nut and the tuners i think.
