About 2 weeks ago a teacher took my ipod, and i need to know if she has the power to do this to me.

Here's how it happened:

I was in my 6th period classroom when some jackass pulled the fire alarm and everybody had to go outside. This was at 2:38, 2 minutes before school ends. I have my watch synced with the school's clocks, so i knew the exact time. So, we went outside, and when we were told to come back in, I looked down at my watch and it was 2:41, and I figured I'd be safe putting my headphones on as i walked into the building. When I reached the doors i noticed that there was a teacher by the door, but i figured i was safe, and she wouldn't confiscate my iPod, since school was over. As I'm walking past her, she stops me and demands i give her my iPod. Naturally, I tried to convince her that since school's out, she has no right to take it from me, but she snatched it out of my hand, and said that since i "backsassed" her that she was never going to give me my iPod back.

So, does she have the power to do this?

Is what she doing legal?

I imagine the law is similar where you are to in the UK, but here the law states that a confiscated item MUST be given back to a pupil at the end of the day, or if the parent/guradian of the pupil is notified and ok with it, at the end of the week and no later.

Like I said, that is the law in the UK and my mom printed off a copy of the more-detailed document stating that, to get my brothers' phone back when the school confiscated it and she couldn't contact him to find out where he was (he'd been out with friends) until 10pm.

She was pissed off they hadn't given it him back at the end of the day and they tried to argue it was their policy until she showed the document to the headteacher who then apologised and gave the phone back.

I think you knew the answer to this before you posted. If you had any balls, you wouldn't have let her take it in the first place, so you probably won't have the balls to get it back. Obviously, she has by now deleted all your music, replaced it with her own, and has your iPod playing in her ears right now.

Go in, and inform her that you will be reporting her to the board of education, telling them exactly how she took it and what she said when taking it. Tell her that the keeping of someone else's property without intention of returning it is illegal and you will take the matter to the police if necessary, should she still refuse to return your property. Then politely ask her to return your property or else the above circumstances will be met.
Then of course if she doesn't return it, do the above.

yes, she can keep it until the end of the year. just tell your parents to pressure her, she will back down. they cant take that. if it doesnt work have them threaten to go to the school board. then the principal will also be pressuring her, and its done.

do not try to get it back by yourself, you will lose.

Now, I'm not familiar with foreign law on the subject, but she definitely can't keep it til the end of the year. I'm 99.9% on that.

Read my earlier post for clarity on why I am so sure.

Yeah, I know my school won't return it until a parent comes to pick it up, but they cannot keep it. It must be returned at the end of the year at the very latest.

I have a friend who had a similar situation. He was walking toward the bus to go to the soccer game (About five minutes after school has ended) and his cell phone fell out of his jacket pocket. The principal himself said that you would be allowed cell phones so long as you didn't take them out in class. For afterschool activities and stuff. So the cell phone comes out, and the VP just happens to be standing right there, and commands that the cell phone to be given to him. Needless to say, my friend ended up having to get his parents to come pick it up, and ended up having a day of in-school suspension (Basically Isolation from usual classes, having to do all your work in an isolated trailer.)

Seriously, American schools are so full of bull.

Weekend and after school detentions and all that piss?

Here teachers aren't allowed to confiscate your stuff longer than the school day (It's your stuff!!) and detentions can only be given during school time (lunch and break)

2. Normally, I would have dipped when she tried to take my iPod, but since 600 students were going in those doors, I had no room to run.

3. Some of my friends have had this teacher, and they say that she is a power hungry bitch, so I decided against fighting her for it, because she has done worse to other students.

Are there maybe any not quite legal things I can to to get back at her?

Threaten to put a plastic bag over her head and dump her in a river if she doesn't your ipod with a full and frank apology. Don't take that shizzle man she took your property!!! Slash her tires, burn down her house, torture her children.. whatever it takes!

no. ****ing dont. bad idea. teachers can **** you up so bad. it doesnt matter if their wrong, theyre always right. if you challenge this teacher, especially if she is as power hungry as you say, she will mess you up. **** like this can escalate fast.

go through your parents, its the only way to get the situation done well.

of course, if you want to be a rebellious loser, go ahead. post what ends up happening to you.

Ask for it back politely. Explain that you were not causing anyone harm, and were not disrupting a class with it.

If she refuses, go a step higher to an administrator. If they refuse, involve your parents.

If you and your parents cannot get it back, file a complaint with the school board. If that doesn't work, report it as stolen property to the police.

If you make a huge deal out of it, they'll eventually just give it back. Be calm and direct during the whole thing, even if someone else becomes upset.

School finishes at 2:40 for you guys!!!!! OUTRAGOUS!

I know that in most schools around my area in Australia, their allowed to apply school rules to you while you are on school property or wearing your school uniform on the way home. So, in theory, you can't use your i-pods until you get home here...

They can however confiscate it for an undterminable amount of time. However it must be returned before A) end of school year, B) before you leave the school to go to a new one, C) when a parent of guardian tells them to give it back.

Dude wtf!!!

You dont simply give her the iPod, is yours and after school, you just ignore her and contnue walking. I mean in my highschool times I didn't even gave my cel phone when they asked me for it, even when I was using it on class period. Grow a pair!!!

Don't do anything physical to her!

Don't talk to anybody about what you intend to do, or what you did do. Ever.

And take some time to think about the consequences of your actions. Are you ready to get punished for it if things go wrong? I mean, are you not already listening to a brand new iPod your parents got you? Is it worth to go to war over an iPod?

But if you really want it back...

... I'd pull off her wheel rims. They come off quite easily and they are not protected by alarms.

Tell her you think you know who has them and you could negotiate to get them back in exchange for your iPod. If she doesn't want them back, you can just sell them.

Don't tell her in front of witnesses. Don't do it to show of or something. Don't threaten her. Just tell her calmly you want your iPod back. Don't get her upset. If she starts threatening you, walk out and deny everything. It's unlikely she would file a complaint about it, since she is the thief in the first place.

You can get her wind screen wipers too, and her rear view mirrors. There's all kind of stuff you could easily tear off a car without damaging it. If you are strong enough and have the gear, you could even pull off a couple of tires. Tires are quite expensive you know.

But be honest. If she returns your iPod, give her back her stuff in good condition. You don't want to debase yourself to a common thief or a vandal. You are above that. You do it to get back what was stolen from you.

Never ever admit that you have her stuff. Tell her you think you know who might have it and you could get it back to her. Don't hide the stuff in your room, or in your locker.

If she doesn't have a car, get her cat. Or her mailbox. Get something that is not worth calling the police for, but dear enough to her to make her think.

Don't steal her baby either. Babies are hard to sell and not easy to hide. And they smell.

Best of luck, and if you're smart we will never hear how it turned out.

You should follow her home, steal her dog, and send her pieces of it until you get you ipod back... Or just do something more legal like talk to the principal because thats some serious BS man.

I don't condone any physical harm against people or animals for something like an iPod. Of course, if someone close to me would get raped or badly harmed, there's no question about it: the perp is a goner.
