Hey UG, how's life? Great. Everyone pay attention to me now.

My school's cell phone policy is If they see it, they take it. You can not take it back until a parent comes to get it... And I wasn't going to argue that and get suspended on a day I have a final exam, so I gave it up.

It's just strange to me that they can just TAKE my personal property. I bought that cell phone with the money I earned at my job.

Let me know what you guys think...

shouldnt have been out. it's a pretty lame rule though. something about being on a public school property strips you of most of your rights though, im not sure completely about it.

I dunno what the rules are, but when you enter the school I think you're giving up certain rights, which to me is ridiculous, but sort of necessary.

You're not supposed to have them. They can't physically take it from you, they have to ask you for it. But if you don't give it to them, then there will be repercussions.

It's funny how they teach you in school about your personal rights and all, then completly ignore them.

On the other hand, by entering the school you are agreeing to follow their rules (even though you don't really have a choice to go or not). If for instance, you started smoking in a movie theater, you would be asked to leave, or forcibly removed.

As far as getting it back, it is stupid that they will only give it to your parents

Yeah, It's legal. My school has the same policy, but that's because we have a big drug problem. People making deals with texts and stuff like that. What's stupid, though, is that they also take away any kind of electronics, in some cases including thumb drives.

you know that thing they make you sign at the beginning of the year? the code of conduct thing. it has all the rules in it, and when you sign it, you're putting down your agreement to all those rules. so you can go against their rules, but since you signed their sheet they get to pick the punishment, or then can take you to court and sue the sh1t out of you since they have your signature of "agreement".

Schools are federal buildings, and have the full ability to take your rights away, in the US, anyway.

That's why they can tell you what you can and cannot say, and what you can cannot wear, etc. Then they have the insubordination rule, which is, basically, the all covering rule. If you do what they tell you not to do, that's insubordination, and they can discipline you for that.

It's bullshit, IMO, but I deal with it, because I'm only going to be there one more year, and then I don't have to worry about it.

It's the same everywhere. I've been told that, by walking into the school building, you surrender all of your rights. If that is indeed true, they can do whatever they want with your phone. No, it isn't fair, but you can't really do anything about it.

I was in no way "bitching" about it. As I said I gave it to the teacher without one word of argument. I was just wondering, as it seems odd.

Not just safety, but also preserving order. Can you really expect a lot to be accomplished in class if everyone is just texting all the damn time? No. It's the same as them being able to regulate how people dress.

This is a huge problem at my school.

Similar story, these dumb preppy girls who go get drunk all the time and put photos on facebook were complaining for about 30 minutes straight during calculus a couple weeks ago. This particular incident was prom night. They were so worried about getting cought, not being able to walk at graduation, how the rules aren't fair. God, if you're so damn afraid of the consequences, don't do it, definitely don't bitch about it.
When I hit 'em from the back, I got them mami's saying dammit man.

Tell your parents.

This has been to Federal Court for sure in Kansas, not sure about Supreme, but a teacher has the right to take a cell phone from a student, but can not look through it under ANY circumstances what so ever. The only officials that can go through a student's phone is the school's administration (Principle, Superintendent) or the Police, only under the suspicion of illegal activity, and only then if a parent or legal guardian is present on the scene to give consent. Your parent/guardian can deny them access, thus requiring them a warrant to search. Most schools don't bother at this point.

They also can not search you for no reason at all. Our school had a big problem with this, and it was taken to Federal, and we won. Administrators by law, have to have parental consent or police order to search a student, and if they do, can not take anything that is not deemed "illegal" by National Law, not their school rules (i.e they can't take your phone, because it is not illegal to carry under National Law, but is restricted by the School).

I just checked, and a lot of other states do this too.
