As some of you know, running mate for mcain, sarah palin has a theme song by heart which is barracuda. According to heart they are using that song without permission, and have asked mcain and palin to stop, but mcain intends on using. but what angers me most is that 55% of aol voters thought that mcain should use it anyway. I believe that they should respect heart and not use there song. Nothing is more fustrating when someone wants your song played in a way you dont want it. and after all i bet heart has rights on that song. discuss, or add comment if something new happened in the situation

mccain has also gotten in trouble for using a jackson browne song, and van halen is also mad for him using their music

Heart should drop the hammer and start suing like crazy. I'd love to see the confused look on McCain's face when he realizes how much the music matters to the artists.

Besides, why the hell is Palin using the song in the first place? I'm pretty sure the undertones of the song aren't agreeing with her pro-abstinence stance.

they're right to be angry. If I heard the song playing I would automatically assume that the artist had given their consent and supported McCain.
If a song is used for political purposes then the Artists consent should be asked for, or failing that if they ask you to stop using it you should.

Agreed. The song is being played in a public venue in front of 10s of thousands of people, not to mention all of the media coverage.

That is definitely copyright infringement.

I believe Palin is using the song because her nickname back in Alaska is the Barracuda for the way she dealt with the state government when she was first elected governor.

AOL online surveys are slanted towards McCain anyways. Their Presidential Straw Poll always has McCain beating Obama by like 65%-35%. It's just because of the demographics who use AOL favor McCain. The polls are meaningless.

Sounds like fair use to me. They play songs at sporting events all the time, and I know they don't get permission from the artists to use their songs (I know the guy that did the pregame tape at my hometown's college). If you aren't allowed to play a song in public then why write it?

It is a civil offense to use anyone's intellectual property without their permission. That guy who did the tape could be sued.

Yeah, but notice how they never play a song in it's entirety? It is always excerpts from songs. That makes it a different matter.
