You have 2 choices in this case. Legalize child porn or charge them. Really how else are you going to handle it? Is it then legal for someone to have a website with 14-16 year old porn pictures as long as they were taken by the one in the photo?

Also i believe in some states there are laws that say if you behavior a certain way you are to be considered an adult. So how does that effect this? Is this still child porn or because of their action it is now legal because they are acting like an adult. That has problems because it then makes all child porn legal if they choose to do it.

Discuss.

You can't really do that because this isn't something that is going to go away. It will only get worst if they do nothing.

Well, given that the pictures could easily have been passed onto anybody, not just her classmates, I don't see how they can not charge her with something. It's illegal to produce and distribute pictures depicting the sexual conduct (or nudity, I imagine) of a child. Just because we tend to think of child pornographers as middle-aged men doesn't mean that the law, or the thinking behind the law, doesn't apply to everybody. It's meant to protect children, and while I think the S.O.R for 20 years doesn't really make much sense, she shouldn't have taken nudey pics of herself and shown them to everybody! Like I said, they could have been (and probably are now) distributed to many more people than she had originally intended. It sets an example, I guess?

So is it legal then for someone under 18 to make a website with nude pictures then have a disclaimer on it much like many porn sites that say if you are over 18 leave if you are under 18 please pay me money for my nude pictures?

Maybe, but then what if it is a 17 and 18 year old. It is a problem that has been growing for a LONG time and needs to be addressed. Do you change everything over from 18 to an age at which kids are not having sex? Or do you still keep trying to deal with these things on a case by case in which it all depends on that judge? They aren't decreasing in number they are only increasing.

ok i understand the whole thought that maybe the pictures could get into the hands of someone over the age of consent. Then its quite wrong. But the fact that SHE took the pictures and SHE sent them to others her own age. I dont think she should be arrested and charged with that. This is one of those issues that cant be solved with a solid set of rules. Its really a judgement call...

Interesting topic of debate =) and i am bored.

I like debates on cause and effect type issues.

Under current laws she should face the same thing as anyone else. I think it is the same problem with statutory rape laws when a older guy vs woman is involved. It should be the same penalty but it isn't.

Where were girls like this when I was in high school? Same thing for teachers having sex with male students. I really would have loved to hook up with my 28 year old Italian teacher in 7th grade. She made it hard (pun intended) to concentrate in class. A lot has changed in the 14 years since high school.

Is she making child porn by taking pictures of herself nude? What if she just keeps them on her camera... does it only become child porn if it's public?

I think common sense needs to apply in these situations, but sadly, it doesn't..

She was wrong to send the photos to everyone, but that doesn't make her a sex offender. Personally, I'd let her go and send some more pix, then wait till she gets molested by a divorced 52 year old man and see if she ever takes another photo of herself again..

I'm so proud to live here. We had this one photo that every single person at our school had on their phone, there were these 2 good looking girls posing together with whipped cream over their naked parts. Our teachers talked to us about all this bull and getting arrested if caught and stuff.
