Friday i have court for a speeding ticket that i really can't afford to pay. I live in Indiana and i know if the cop doesn't show up i automatically win, but does anyone have any tips to get out of it? for those who care here is the story below.

STORY: I was leaving my school after a football game. I started leaving the parking lot behind the other team's bus who would be turning the same way as me and i didn't want to follow it. I cut across the park lot to leave through the other exit, in front of the bus. i guess the school cop thought i was going too fast so he pulled out behind the bus.

I kind of pulled out in front of the bus and had to gun it to get some more comfortable room between us. the cop passes the bus and sees me going too fast, so he shoots up behind me.

I can't tell its a cop, i just see someone come flying up behind me and then not pass me so i'm concerned and slow down to like 40 (in a 45 zone) he stayed on me which didn't make sense to me cause someone who was just in that hurry would have just passed me. so i sped up to just get distance between the crazy driver behind me. but he stayed right behind me. as i came to where i need to turn i'm going like 70 and he's still waay too close to me, he sees my turn signal and turns on his lights.

i think its total BS and i think the judge might too when he heres this story, but idk how it all works so idk. thanks for any advice!

He should have hit the lights straight away, that's all I know.

You're not going to get the ticket taken away, i know that. If he was just giving you a ticket for speeding to get away from the bus, it might have made sense. However, you were just driving along, a guy started tailgating you, and you sped up to 70 MILES PER HOUR. You're getting a ticket.

My friend actually went to court recently for 2 speeding tickets and they were both dropped. Hopefully you can get out of it too.

but seriously isn't that the safer move? to get away from the crazy driver? and it wa sprobably more like 65... but still. also, the cop did break the law too, would that have any leverage?

Dude, I hate to break it to you, but the tickets for a cop following you are nearly impossible to get out of. If the cop was trailing you and you were speeding, he can get an exact reading on your speed. There's really no excuse. Sorry

if its your first time they'll probably drop it, assuing it isnt to bad, unless its 70 in a 45, thats pretty bad. but alot of times for a first timer, they'll make you pay court costs( like 30 dollars) and maybe take a drivers ed course.
#11
The cop is probably going to say that he was tailing you so he could run your plates, then you sped up way too much and he pulled you. I doubt you'll get out of it but hope for the best.

What law did he break, exactly?

I really don't think cops can stay on your tail that long and not flip the lights on, its like you're being provoked. When you tell your story try to have just a TINY whine in your voice, maybe you will get some sympathy.

What are the chances that a cop wouldn't show for a ticket??

I got one on sunday for going 80km in a 60 zone...fack. It's a pretty small ticket, only $95cdn, so I'm wondering if the cop will see it as insignificant or not..?
#17
Yep, cops usually schedule your court date for the day that they will be there.

that's not what i meant by that comment, i was saying that i'm not a "bro".
i didn't think/insinuate that they were going to let me off because i'm a girl, prick.

i seriously doubt they're going to allow her to use a prayer for judgement on a ticket for doing 70. you can pay 80 bucks or so and take an 8 hr. defensive driving course. its a bitch. its all day. one 15 min. break, and sucks. but its better than higher car insurance

My bad lol.

I hate insurance I don't have my full license yet(once I do ins. will drop $30 to $190cdn) and I drive a Ford Probe GT.

18y male + sport compact= Me bending over and taking it once a month.

my insurance is only $90, but my car is deff nothing to brag about. and i'm jobless as of now, so my insurance really can't go up at all, or i'm taking it once a month as well.
except i'll be getting it in other ways, too because my mom will be bothering me until i get a job.

That's a myth. There are a hundred reasons why a cop may not be able to make the court appearance.

In Canada ( don't know about the U.S ), we've got traffic ticket specialists who are typically former police officers. They'll represent you in court for a fee. The fee is usually about the cost of the ticket. The majority of the time, they'll get you out of the ticket and demerit points.

Good luck

In the US the guy that wrote the ticket has to be there. Unless you have already plead guilty and the hearing is for setting the punishment.

Here's how you do it man. First call the court and ask for a postponement. They will in almost all likelihood grant it.
Next get the name of the cop off of your ticket and start calling and asking for him at the cop shop. After a few days you will figure out his schedule. When you know what days he has off you call back to the courthouse and schedule your hearing for that day of the week.

no, the recommended option is to slow down so that they either overtake you or, if he stays behind you, to allow for the extra stopping distance if there's an accident ahead.

regardless, you still broke the law and there will be evidence of that.

In Canada it's the same... BUT if prosecution requests an adjournment to another day, it will likely be given unless you know how to argue against that request. If you're representing yourself in court, I doubt most people would be able to argue the request.

Most traffic cases in the US are heard in front of a Justice of the Peace. No prosecution involved.
I've been to court 4 times for traffic violations. I won 3 of them by simply finding out what day the cop was off. Unless you really made an impression on the cop he is not going to worry about it. He did his job.

I don't know what the laws are over in the states (I'll assume you're from the states)...

But many people go to their court hearing just because they know the officer WILL NOT SHOW UP...

If the officer doesn't show up and you plead innocent, then you are OFF THE HOOK.
#33
Not sure where you are located. But sometimes it is better to plead no contest if the officer shows.Hopefully they will withhold judication and not give you any points on your license. You may have to go to driving school though.Unfortunately it is going to cost you no matter what happens.Best case the officer is a no show.

If you went 70mph in a 40 zone, you deserve more than a ticket. Reckless idiot.

If you thought it was a crazy driver behind you, why didn't you PULL OVER and let them pass instead of speed away?

the ticket was 65 in a 45 so your off by ten mph, though i did say 70 as an overstatement cause i wasn't exactly watching my speedometer. and 70 is a perfectly safe speed by its self. no one was gonna pull out in front of me, i had cornfields on both sides and not really room to pull over cause its a pretty steep ditch and i didn't want to worry about being able to get out.

but thanks for being self rightous

If there is ever a driver behind me who drives bad, I always go 5 under. If he needs to pass, do it, you don't need to speed up to 70mph.

its, true, i'll admit that was a poor decision, but not a horrible one. i was pretty freaked out cause he came at me at like 90 then just stopped probably half a car length to 6 feet behind me. I could barely see his head lights. and not that it changes that i sped but i've always been taught to not be near crazy drivers so i wasn't interested in hanging around to see what would happen cause when i started speeding up i was about a mile from where i had to turn.

130$ Ticket, =S

Stupid move on my part.

Shouldn't have sped up =/
