Breaking Benjamin are literally broken, after frontman Benjamin Burnley fired the rest of his band via email. According to Noisecreep, Burnley fired guitarist Aaron Finke and bassist Mark Klepaski when he heard the pair allowed Hollywood Records to issue a remix of their song "Blow Me Away" without his permission. Now the singer wants at least $250,000 in damages, and exclusive ownership of the band name. The ex-bandmates deny Burnley's claims, and say their 2009 agreement which gives Burnley the right to "dismiss the pair with due cause" is invalid because the singer told them one year ago that he couldn't perform live concerts due to illness. Rock AAA report that the singer has only appeared on stage twice in the past year. Burnley maintains that he has the exclusive right to continue under the Breaking Benjamin banner alone. It's no wonder the group are fighting their corners. Since their signing to Hollywood Records in 2002, they've sold over 5 million albums in the US alone. Meanwhile, Breaking Benjamin (whoever that is) will release "Shallow Bay: The Best Of Breaking Benjamin" on August 16. It will include all their chart hits, a disc of rare recordings, live performances acoustic demos and remixes - including the very one that caused the current conflict.

    How is he selling out? He's trying to retain the integrity of a song the record label has already beat to death. His band mates took a song that he is solely credited as the writer of, and they gave the record company permission to remix and release it (again), only this time with I guest performance from someone I've never heard of. All he wants is to get paid for the theft of his song and the rights to the name he had before these guys came along. I'm sure he would like to un-release the song, as well, but that's not possible, I imagine. It also seems like he didn't find out about the remix until he received a copy of their greatest hits. So, firing your bandmates via email is equal to finding out about your bandmates' business decisions via your own damn album. I don't even really like Breaking Benjamin, but I don't see anything wrong with this guy's actions. If he hadn't done this, yet expressed his disdain for their actions, you'd have all been calling him a pussy for not doing anything about it. Consensus: UG readers like to bitch about stuff.

    If you made a track and had it given to your record label without permission by your friends/bandmates and dubbed over by another vocalist from your label that you have probably never met, wouldn't you be angry as well? I'd be pissed. As much as I dislike the idea of them splitting up, the fact is he's got a good reason for it.

    This is only a reflection on your life. I don't even try to hear them and I hear them all the time. Aside from that, I ran across one of their videos one time, and the bass player was just an idiotic distraction. Looked like a hip hop fairy with his hat on sideways and trying to hold his bass in silly ways. He stuck out like a sore thumb and should have been fired a long time ago. This band is not too bad, but their songs are too simple, they sound like they should have been developed more.

    This really hurt me considering i'm a huge BB fan. However, this is a good lesson for those bands out there!

    Not really but he has a ton of problems. A thousand phobias, a recovering alcoholic and has some type of mental disorder which just affects his short term memory. I think Benjamin is over reacting but I can understand his position a little bit. He created Blow Me Away so I guess it can kinda feel weird having a song that you care about (even though it's about Halo) being changed up. No matter what happens, this will not end good.

    They never really "changed" to mainstream. I wouldn't even call them mainstream, they were no were near as popular as Hinder or Nickelback, it was probably just one of the top alt metal bands.

    Please have this be fake, one of my favourite bands and I was hoping to see them come back from hiatus. The Blow Me Away remix has been out for well over a month anyway and they've even released a video for the original, surely all this would've happened sooner if they are being fired?

    i don't get how these guys sold 5 million records. there's absolutely nothing original about them. i personally think they're awful. plus their drama queen singer pulls an axl. who cares if they're remixing your song? if you want to get paid for it and all your fans hate it, they'll think you personally had something to do with it.

    Ever tried covering a Tool song as a band? Schism is one of their easiest songs to play, and it was still tough to keep together. Those guys are true composers. On subject, you could say Ben had a "Breakdown".

    The Pumpkins were never great at any time. Breaking Benjamin are not great either, but I'll take them over the Pumpkins, their horrible singer and crap songs any time.

    Burnley was in the right here. The song was his. BB were one of the better bands of the decade in my opinion, but Burnley was the talent in the band. He wrote the lyrics, music, played guitar, sang, etc. He could go on without these two and there would be little difference in the sound of the band.

    They aren't done. He'll find other people to replace them since he is the band, the rest are totally replaceable. As for what I think of them as a band, they are okay. They can come up with a few good singles each record, but their cd's as a whole are so so with more filler than good solid songs. Let's just put it this way, they don't suck as bad as Puddle of Mud or Nickelback.

    Saturate, We Are Not Alone, and Phobia are solid albums IMO. I'm a nit-pick when it comes to fillers, and Dear Agony does have a few, but you can't say that about the rest of their albums.

    That's what I was thinking. I heard the remixed song, or what i believed to be such, and i was wondering why they would re release it. I hope they can come to terms with each other. It's a shame if this band stops making music.

    Monotone, do you know what that word means? Listen to The Patient or any of their songs. The man has crazy range. I agree that the fans are ridiculous though.

    I'm chilean too, believe me your english is pretty good. Liked some of this band songs, but not of my favorites band at all. Of course is totally unprofessional and coward to fire your band via e-mail.

    First Distubed announce they are going on hiatus after their tour, then Kings of Leon cancel their tour, and now this. It's a horrible music holocaust. Dare I say that mainstream music has a chance to be good again?

    Sounds pathetic to me. I would be honoured personally if someone decided to make a remix of one of my songs. I wouldn't be fussed if they tried to sell it on either, because THEY worked hard on making the remix. Firing your band for this? I don't know much about the band but from this article alone, he comes off as an absolute a-hole - a la Axl.
