Singer/songwriter Jackson Browne is suing Republican presidential nominee John McCain and the Republican party for using his 1978 hit "Running on Empty" in a recent TV commercial. In the suit, filed in U.S. District Court in Los Angeles, Browne claims McCain and the party did not obtain permission to use the song for an ad in which "Senator McCain and the Republicans mock Democratic candidate for president Barack Obama for suggesting that the country conserve gas through proper tire inflation." Browne, a lifelong Democrat, is seeking unspecified damages as well as a permanent injunction prohibiting the use of "Running on Empty" in any form by the McCain campaign. "Not only have Senator McCain and his agents plainly infringed Mr. Browne's copyright in 'Running on Empty,' but the Federal Courts have long held that the unauthorized use of a famous singer's voice in a commercial constitutes a false endorsement and a violation of the singer's right of publicity," says Browne lawyer Lawrence Iser. Thanks for the info to Billboard.com.

What the ****? That's ridiculous. I can't tell you how annoyed I'd be if a political party I disagreed with used my music on a campaign. Although this is quite good, because it shows what a cock McCain is.

Haha, I'm sorry, but I don't see how it makes the party pathetic by using the song, even if it is to "misinform" the public. The way I see it, both parties are pathetic and the two party system is so amazingly flawed that something like McCain using an unlicensed song shouldn't even get this kind of publicity (of course this is a music site, so I understand).

to the moderator: there's more to this article than just "mccain using this song without permission" that's very communist of you.

Haha, ridiculous idea. If I were McCain, I'd use Metallica in my ad campaign. Then EVERYONE would vote for him.

i dont blame browne taking action in this seems the use of his song in teh campaign ad implies he agrees with their policies.

take the politics to the ONLY POLITICAL THREAD. i won't warn/delete for it now because i am in a good mood, but from now on if people talk politics, other than mccain using this song without permission (if you can even call that politics), they will be warned. also, no bashing of either candidate will be tolerated in this article.

rofl. I love that people feel that on a forum where there are rules in place for a reason, they somehow don't apply to certain things. Anyway, I've never liked McCain, he's a bit conservative for me. This is kind of a dick move. How in hell would you not consider that maybe the artist needs to give consent for his music to be used?? I'd be especially pissed if it was a candidate I don't support. And in this case it's a candidate Browne doesn't support, AND he's taking a jab at the other candidate using his music. That's just awful.

Wrong to use the music without a liscence. Any promotion Co. knows that... and I doubt that it was done as portrayed. It seems to me Browne is out of cash. Hasn't had a hit in a while either... sue sue sue... milk the situation for some publicity too and maybe someone might just buy a copy of the song eh?! Trouble is, lawyers are standing with their finger trigger happy on the sue button... there are many other ways Browne could have and should have resolved the issue.

normally i'd agree with this statement, except that this time,Dylan has come out in full support of Obama. I agree with the first part though,if McCain somehow wins, then you'll see me in Canada

Wow. Moving to Canada. All you "Americans" sure are patriotic. Neither candidate is a very good choice. But I'll stick to the one whose not a socialist. You know, Cuba was once like this country in somewhat recent of history. They wanted CHANGE. they got a socialist (now communist) with the same ideas as Obama. His name was Fidel Castro. You all need to educate yourselves. This article is going to spark up some nasty debating I'm sure. Jackson Browne should have just told them not to use the song. Not sued. Everyone suing over bullshit like this is what's ruining our country. In the 70's nobody sued anyone.

I can't vote in your elections because I'm not American, but for gods sake, vote for Obama. McCain just wants to ass rape every other country in the world.

it's better to have a short term plan while, longer term plans are being developed, than to have no plan at all. McCain has no plans, not even a short term plan that will help anything, and this was a shot at Obama, simply to make up for his (McCain's) lack of action.

That's awesome. McCain's a dumbass for using the song and for insulting Obama for promoting proper tire inflation, because that's proven to save gas.

Jackson Browne is an Idiot and so is Obama, lol. Obama doesn't have a clue on how to be president, not that i'm a huge mcCain, but a few months of experience isn't enough to get my vote.

and this is politics and they will take a shot at anything even if it represents total hipocrisy. mccain has an energy plan by the way, and so does obama, but i feel we should talk about those instead of just tire inflating and taking jabs. +1 to your first sentence though, i completely agree with that statement.

+1 I'd rather see someone who is inexperienced but has passion over someone who just agrees with what the retard before him said, and sounds like hes sleepy when he talks. I'm not ready for another 4 years of bush, because with mccain thats what we are gonna get.

i dont understand why everyone is making fun of obama for wanting inflated tires. its been proven that it increases gas mileage by like 2%
