No Doubt have reportedly won a favourable early ruling concerning the band's lawsuit against video game company Activision Blizzard Inc.

The rockers are suing Activision over misuse of their likeness for avatars in rhythm action title Band Hero.

A Los Angeles County Superior Court judge issued a ruling rejecting the gaming giant's effort to invoke freedom of speech protections in defence of its use of the No Doubt avatars, says the Los Angeles Times.

Last year, it was reported that Activision refused to alter the content of the game based on the band's suit because it would prove "too expensive".

The company has the right to appeal.

    Well, seems to be going how everyone expected it to go. Though fyi, copy&pasting other people's articles isn't exactly good form among gaming blogs and someone is liekly to get in a bit of an arse about that.

    Activision kinda screwed up Guitar Hero. They made it like "HURR MOAR ATTITUDE" and "HURR MOAR BUTTONZ" They hit the mark on the drums though.

    Actually, it was reported that Guitar Hero became a lot less profitable last year, thats why they haven't released 10 of them this year.

    i know several people who have taken up guitar, Succesfully, after playing guitar hero. also as someone stated before its a good way to come across new bands.

    yea but how many people do you think downloaded the lady gaga songs to play on it? sure maybe 1/100 of the people that played might have tried to play an actual instrument for 30 seconds then gave up but even more people are just trying to beat through the fire and flames on expert

    You people are ridiculous...I don't know how many people have started playing guitar because they played rock band, or guitar hero. However, nice to see activision getting raped. They thoroughly deserve it.

    regardless of who suing Activision and for what reason they dug themselves in. Right i'd exspect them to loose more profits that they keep firing more people at infantry ward, the studio behind Call of Duty.

    I'm happy that Activision is getting the shaft, but Harmonix (Rock Band) hasn't really done anything to deserve the same treatment, in my eyes. I know some people hate the rhythm game genre, and that's not the argument I want to start. Everyone has their opinions. But for people who DO enjoy it, it seems Activision has lost a lot of respect while Harmonix is still reputable. As a guitar player, I acknowledge that Guitar Hero is nothing like real Guitar. However, Rock Band got me into drums, so I can see how it is influencing kids to get into REAL instruments instead of the plastic game controllers.
