Former Blink-182 drummer Travis Barker has tentatively settled a lawsuit against the Rockstar energy drink company over the use of his picture to promote the product. Terms of the settlement were not disclosed in court papers filed Friday in Superior Court. A call to Rockstar Beverage Corp.'s attorney was not immediately returned Monday. Barker's lawyer, Gregory Weisman, said both parties were still working out terms. He declined to elaborate until the deal is completed. Barker's lawsuit claimed invasion of privacy, unfair competition and misappropriating his likeness to promote the product. The lawsuit said the Rockstar Web site published a photo of the 32-year-old Barker "holding a can of one of Rockstar's beverages, and identifying him and his endorsement by name" without his consent. Thanks for the info to Yahoo! News.

And did they let him on that show because he has a cool tattoo, or because he was in a band that sold over 1 million albums and had a record hit #1 on the top 200 chart? And is +44 all over the radio and mtv? they're sure as hell not over here. terrible argument

I agree that this is not music news, he is a musician yet this is not about anything music, it's about him crying about some stupid bullshit to get free money.

Usually people are entitled to opinions, but in your case, you're just wrong He's more of a musician than you'll most likely ever be And this is coming from a guy who wasn't very fond of Blink 182

wow.....they said he drank some crappy energy drink, and hes mad? that shit must suck real bad

haha i love how everyone is whining that this isnt news, no one cares, travis sucks blah blah blah yet all of you cared enought to take the time to read it. and travis is a solid drummer

Um.. I actually dont think that he cares or doesnt care about being on that energy drink. If they put any of your pictures, you'd sew also because it's an easy way to make money.. thats all. I don't think that he has underground "cred" to be defending or anything, its just a question of easy money.
I don't think he'd sew I think he'd sue. It isn't a matter of easy money, he doesn't need to worry about money, or underground "cred", because he isn't underground. No one has the right to use someones face as a means to make money without consent. Did everyone forget about when Doc Martins' used dead rockstars to promote their shoes? It's just wrong.

I think he did nothing wrong actually. Personally, if I were a musician, I wouldn't like for companies to use my name without my consent, because I don't think I would endorse other companies for profit, as I think that's arrogant. It's like you're selling yourself as opposed to your music, which is what matters. I think Travis was certainly in the right in his lawsuit. Why should companies take advantage of his fame without any permission from him?

Mainstream Rocker = Pissy little baby who just wants money. He IS a fake will always be considered a FAKE!

all u kids are dumb it WAS unfair cuz ROCKSTAR didnt have permission. If I was travis Id be suing too, maybe not so much for the money (cuz id alreayd be fricken rich) but to show them they cant do stupid shit like that. and dont anyone reply and be like "Ya well ur not travis so stfu" cuz i really dont care And travis IS a drummer. nobody produced him or anything, he learned drums and shit ON HIS OWN and thats why hes gotten to where he is. Blink 182 wasnt a fake punk band. who cares about what style of music they were considered? all that matters was they were and arent anymore so quit crying
    Lacebad
I don't get it. i have my favorite beers if someone took a picture of me with a beer, put it on a billboard with "lacebad likes Guinness" wrote beside it in big feckin red letters, i'd see it and say "hell yeah I do"

What Travis is objecting to, is the use of his image and position to sell something he didn't want to endorse. The company could have contacted him, yet they didn't. What they are doing is completely illegal. If someone put my photo (Hehe.) on an energy drink, I'd be pissed. I'd want my image removed or compensation. Travis is a pretty good drummer, I'd like to see some of you guys do what he does. It would be downright hilarious. Hate me? Don't care.
    David_Bowie=GOD
I dont see why you people are saying he needs to stop being a bitch about it and that hes in it for the money... wouldnt you be pissed if someone put you in an advertisment without paying you or asking you first? If that doesnt then how about a product you dispise.
    ranikade3
so basically your saying you gave up on logic and reason?

why do you metal guys even read this shit just to post shitty things about it. and give the guy a brake he just survived rockstars attempt on a hit. (kidding but maybe not really lol)
    SAINTJIMMY9999
As much as everyone on this site seems to hate him, he is a good drummer (better than most of the Ringos in music - both corporate music and indie music) 1. He is a well-known professional musician 2. This is "music news" which is news about well-known, professional musicians 3. This lawsuit pretains to a pro musician, which makes him part of "music news", making the lawsuit part of music news Besides, its not like there's a surplus of REAL music news out there. Just imagine: "Slayer's new album: A Crossover to Pop sensation!"

The whole point that everyone with at least a brain is making is THAT ROCKSTAR USED HIS PICTURE WITHOUT PERMISSION. I don't know why its so hard for everyone to understand that!!!
    saviordethroned
wow this issue is going to be resolved.. i can finally sleep at night.. thank god.. the fact that he's getting money is upsetting you guys?? is it taking away from the money that rockstar would be giving you?? i can't believe so many people are saying he's doing the wrong thing.. if you were in his situation.. you'd do the same thing..

To all those who say that he's being a dick... How about if your face was used to promote, I don't know... treatments for VD, tampons, or the Nazi party without your permission, I sincerely doubt you'd sit back and let it happen.

You're probably one of the lonely teenagers who sits around in his room, drinking rockstar energy drink, playing 3 crappy sounding power chords over and over again, dropping your guitar down to C because thats so metal, calling your mom in every 5 minutes to hear the next scratchy note you added on to your rock ballad, because she cares so much...
i find this comment irritating. hey, every kid has gotta start somewhere, right? at least they're holding a guitar instead of being all 'ooh jay-z! t-pain! fitty-cent!' ...am i right?? but seriously, you sound like an ignorant moron. i mean... wtf?

It uses the qualifier "tentatively" then talks about how the case is being negotiated outside of the courts, so I guess the title means as far as courts and juries are concerned?

I don't understand why people are blaming him... He didn't do anything wrong... a lot of the money he has is from endorcements and things like that. This is part of his job, and I'm pretty sure no one likes to be ripped off at their job...

IT'S NEWS. what a stupid argument. just shut up. and as for travis, he needs to quit being a ****ing baby

Nothing ironic, and no, you're not right at all. Him not wanting his image associated with the energy drink has absolutely nothing to do with whether or not he's an actual rock star. He's no phony either, he's one of the most talented mainstream drummers in the world Have you no logic?

I agree with you but he is by far NOT one of the worlds most talented mainstream drummers.
