Travis Barker Settles Beverage Lawsuit

Travis Barker has tentatively settled a lawsuit against the Rockstar energy drink company over the use of his picture to promote the product.

Former Blink-182 drummer Travis Barker has tentatively settled a lawsuit against the Rockstar energy drink company over the use of his picture to promote the product.

Terms of the settlement were not disclosed in court papers filed Friday in Superior Court.

A call to Rockstar Beverage Corp.'s attorney was not immediately returned Monday. Barker's lawyer, Gregory Weisman, said both parties were still working out terms. He declined to elaborate until the deal is completed.

Barker's lawsuit claimed invasion of privacy, unfair competition and misappropriating his likeness to promote the product.

The lawsuit said the Rockstar Web site published a photo of the 32-year-old Barker "holding a can of one of Rockstar's beverages, and identifying him and his endorsement by name" without his consent.

    As much as everyone on this site seems to hate him, he is a good drummer (better than most of the Ringos in music - both corporate music and indie music) 1. He is a well-known professional musician 2. This is "music news" which is news about well-known, professional musicians 3. This lawsuit pretains to a pro musician, which makes him part of "music news", making the lawsuit part of music news Besides, its not like there's a surplus of REAL music news out there. Just imagine: "Slayer's new album: A Crossover to Pop sensation!"

    The whole point that everyone with at least a brain is making is THAT ROCKSTAR USED HIS PICTURE WITHOUT PERMISSION. I don't know why its so hard for everyone to understand that!!!

    I dont see why you people are saying he needs to stop being a bitch about it and that hes in it for the money... wouldnt you be pissed if someone put you in an advertisment without paying you or asking you first? If that doesnt then how about a product you dispise.

    wow this issue is going to be resolved.. i can finally sleep at night.. thank god.. the fact that he's getting money is upsetting you guys?? is it taking away from the money that rockstar would be giving you?? i can't believe so many people are saying he's doing the wrong thing.. if you were in his situation.. you'd do the same thing..

    To all those who say that he's being a dick... How about if your face was used to promote, I don't know... treatments for VD, tampons, or the Nazi party without your permission, I sincerely doubt you'd sit back and let it happen.

    Nothing ironic, and no, you're not right at all. Him not wanting his image associated with the energy drink has absolutely nothing to do with whether or not he's an actual rock star. He's no phony either, he's one of the most talented mainstream drummers in the world Have you no logic?

    Either way the company is using a picture of him without his consent. Anybody would sue for that. What if a picture of you was used in advertisements? Appart from perhaps being flattered and perplexed, you would want some money.

    Depends on your idea of mainstream. I think he is a fairly decent drummer, I dont see you making millions or anything...

    Um.. I actually dont think that he cares or doesnt care about being on that energy drink. If they put any of your pictures, you'd sew also because it's an easy way to make money.. thats all. I don't think that he has underground "cred" to be defending or anything, its just a question of easy money.

    I don't understand why people are blaming him... He didn't do anything wrong... a lot of the money he has is from endorcements and things like that. This is part of his job, and I'm pretty sure no one likes to be ripped off at their job...

    It uses the qualifier "tentatively" then talks about how the case is being negotiated outside of the courts, so I guess the title means as far as courts and juries are concerned?

    you guys are *****s. he's not a sellout, he doesn't "suck", and he isn't a "crybaby". this is a ridiculous situation and he's definitely right for to take legal action against rockstar.
